These Terms constitute a legally binding agreement between you and JobLinkHR. We may update these Terms from time to time, and your continued use of our Services constitutes acceptance of any changes.

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

If you are using our Services on behalf of a company, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms, in which case "you" refers to that entity.

3. Account Registration

To access certain features of our Services, you may need to create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information about yourself as prompted by our registration forms.

JobLinkHR provides recruitment and HR services, including but not limited to:

  • Job posting and candidate sourcing
  • Resume screening and candidate evaluation
  • Interview coordination
  • Background verification
  • HR consultancy services
  • Training and development programs

We do not guarantee employment or successful placement for job seekers, nor do we guarantee successful hiring for employers. Our Services are provided on an "as-is" and "as-available" basis, and we reserve the right to modify, suspend, or discontinue any part of our Services at any time without notice.

5. User Responsibilities

5.1 Job Seekers

As a job seeker using our Services, you agree to:

  • Provide accurate and truthful information about your qualifications, experience, and background
  • Maintain professionalism in all communications
  • Attend scheduled interviews or provide timely notice of cancellation
  • Not misrepresent your identity, qualifications, or intentions
  • Not use our Services for any purpose other than seeking legitimate employment opportunities

5.2 Employers

As an employer using our Services, you agree to:

  • Provide accurate job descriptions and requirements
  • Comply with all applicable labor and employment laws
  • Maintain confidentiality of candidate information
  • Conduct fair and non-discriminatory hiring practices
  • Provide timely feedback on candidate applications and interviews
  • Not use our Services to discriminate against candidates on any unlawful basis

6. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

  • Illegal Activities: Using our Services for any purpose that is unlawful or prohibited by these Terms.
  • Fraud and Misrepresentation: Providing false, misleading, or inaccurate information.
  • Unauthorized Access: Attempting to gain unauthorized access to any part of our Services, other accounts, or computer systems.
  • Harmful Content: Uploading, posting, or transmitting any content that is harmful, offensive, discriminatory, or violates the rights of others.
  • Interference: Interfering with or disrupting the functionality of our Services or servers.
  • Data Mining: Engaging in data mining, data harvesting, or any other data extraction methods without our explicit written consent.
  • Reverse Engineering: Reverse engineering, decompiling, or attempting to extract the source code of our software.

We reserve the right to investigate and take appropriate legal action against anyone who violates these provisions, including terminating their account and reporting them to law enforcement authorities.

7. Intellectual Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio clips, software, and the design, selection, and arrangement thereof, are owned by JobLinkHR, our licensors, or other providers and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our Services for their intended purposes in accordance with these Terms. You may not:

  • Reproduce, distribute, modify, or create derivative works of our content
  • Use our content for any commercial purpose without our prior written consent
  • Remove any copyright, trademark, or other proprietary notices

8. User Content

By submitting content to our Services (including resumes, job descriptions, feedback, and communications), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such content for the purpose of providing and promoting our Services.

You represent and warrant that:

  • You own or have the necessary rights to the content you submit
  • The content does not infringe on any third party's intellectual property or privacy rights
  • The content does not violate any applicable law or regulation
  • The content is not defamatory, obscene, or otherwise objectionable

We reserve the right to remove any content that violates these Terms or that we deem inappropriate or harmful.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

JobLinkHR DOES NOT WARRANT THAT: (A) THE SERVICES WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICES WILL MEET YOUR REQUIREMENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL JobLinkHR, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (C) ANY CONTENT OBTAINED FROM THE SERVICES; AND (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

11. Indemnification

You agree to defend, indemnify, and hold harmless JobLinkHR, its directors, employees, partners, agents, suppliers, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any rights of another.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Nepal, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

13. Dispute Resolution

Any disputes arising out of or relating to these Terms or your use of our Services shall be resolved through good faith negotiations. If such disputes cannot be resolved through negotiation, they shall be submitted to binding arbitration in Kathmandu, Nepal, in accordance with the Arbitration Rules of Nepal. The arbitration shall be conducted by a single arbitrator appointed by mutual agreement of the parties.

The arbitrator's decision shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. The costs of arbitration shall be shared equally by the parties unless the arbitrator determines otherwise.

14. Termination

We may terminate or suspend your account and access to our Services immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.

Upon termination, your right to use our Services will immediately cease. If you wish to terminate your account, you may simply discontinue using our Services or contact us to request account deletion.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our Services after any such changes constitutes your acceptance of the new Terms.

It is your responsibility to review these Terms periodically for changes. If you do not agree to any of the changes to these Terms, you must stop using our Services.
